Forums > Living in Kunming > Marrying a local...

Hi,

The easiest way to go about it is to go to the embassy and get a certificate of no impediment to marriage which the embassy should translate for you it should be a bi lingual document. First you have to sign a statutory declaration saying that there is no legal impediment to your marriage that you never married, or you are divorced or your previous wife is deceased. The embassy then will issue and notarize the document. In Kunming you will require a passport sized photo of yourself and your fiancee and also a photo of both of you together. Your residence permit, passport and visa and if you have more than one nationality inform the civil affairs office which document you would prefer to use. Also your divorce certificate or death certificate of your previous spouse. If you were married in China previously both of those documents will be in Chinese already otherwise get them translated and notarizied at the public notary office not just anywhere . For futher info on official translation and notarization of documents contact the civil affairs office near city hall on Dong Feng Xi Lu. Formalities should take an hour or so if everything is in order.

Forums > Living in Kunming > KIA 2

Am I to infer from the contents of this thread that KIA has a discriminatory employment in place? One that discrimiated against job applicants on the basis of their personal beliefs? Is such a policy legal in the PRC? Discrimination on the basis of one's religious beliefs (or lack thereof) ?

Article 13 of the PRC labour law states " No employee should be discriminated agianst on the basis of nationality, race, age, religion, gender or disability"

Article 20 of the employment services act says that" no discrimination related items shall be included in a contract of employment or offer of employment"

It would be interesting to get a legal opinion on KIA's present hiring policy if it is as stated.

I have a query about KIA's recruitment policy. Does the school have a preferential hiring policy which favours the hiring of teachers and staff who are Christains ?

Does the school board favour certain kinds of teachers over others on the basis of their personal beliefs? If so how does that influence their with interactions with the student body?

Forums > Study > Dual citizenship holders

Hi,

Attention dual citizenship holders if you enter the country on one passport you must leave the country you cannot leave, work or study using your second passport without first existing the country.

Regardless of the fact that you may have used your second passport previously to live, work or study in China. Changing passports also renders your previous residence permit, health certification and student cards invalid according to Yunda. These documents must also be changed over so the details must match those in your other passport. In other words they have to be done again.

According to the local police under Chinese law they don't recognize the right to hold the citizenship of more than one country. So for legal purposes you are treated as two seperate entities. That is to say that if you are registered as at an address as an Australian citizen but if visited by the police at home and asked to provide proof of residence and your previous registration was done using the details of your second passport. It's up to the police to use their discretion in the matter as to whether you are legally registered according to the law.

To sum up if leaving the country and re entering using a different passport you are required to go through all the registration formalities again in duplicate.

PS. Your school could terminate your previous enrollment and re enroll you as a new student make you pay all one off fees applicable to new students again. They also don't recognize dual citizenship holders either so you can continue your current enrollment and keep the same academic record.

Finally no negotiation will be entered into over the matter.

Excavation is well under way on the site right now and they also seem to be boring down in the corners of the site to establish the foundations for the building. In addition to that the temp housing errected on the site has been removed. We should be able to see evidence of the superstruture rising soon.
