Sorry to disappoint you Lao Tou but in exchange for the return of my belongings and valuables and an assurance that they would respect my home and not approach me or contact me without my consent the police dropped all charges and considered the matter closed. If they hadn't consented to these conditions the police would have charged them on all counts.

The court matter concerned their Plan B which was to petition for a divorce based claims of excessive abuse, harrassment and cultural differences etc and a healthy financial settlement into the bargain. As I argued in court the claims had no basis in fact their arguments didn't hold any water and a cash settlement was out of the question. Cash in exchange for withdrawing their petition so I wanted to contest it in court . That would have delayed the proceedings by months and she was under pressure to settle the matter at once by her family.

In return for no financial settlement, no admission of wrongdoing I agreed to an immediate divorce as the court officials advised both parties.

I agree with outsider, talk about muddling the waters and mean don't mix the abstract with the real. With people we are talking about character, people of good character do good things and people of bad character do bad things how could you possibly tell what kind of person lives in a house from the type of Chinese characters he hangs of his front door.

Facts speak lounder than words judge a man from his achievements or deeds and intentions.

Lylian logic is purely inductive based on the laws of probability that says it if it is true for most of the people then it should be considered true for all of the people including those we don't actually know. It's a presumption eg all Chinese men between 20 and 25 have black hair, that's true for 99.99% of men that not for 100% of men. But it is interpreted as 100% of Chinese men have black hair that statement is simply not true.

Our logic is deductive based on known facts, from what we know to be true the following can be deduced as certain

Fact: stealing and fraud is against the law.

Fact: The police have arrested and the court has convicted person A of stealing, fraud and embezzlement.

Conclusion: Person A has a criminal record, a history of commiting illegal acts. Person A is a convicted criminal.

Inductive reasoning is not wrong or false reasoning but should only be applied in the absence of facts, experiences and stats deductive arguments in other words not as a replacement for them.

Inductive reasoning often descends into generalizations, sterotypes and false premises applying fixed rules or conventions instead of dealing with things case by case, looking for specifics .

Actually my story is on file, a police report was lodged with the police in Wen Hua Xiang Sept 24 2009. The matter was dealt with my the CBI from downtown and later at the local court in Wen Hua Xiao Qu.

Since then I have met someone else and and she and her family have been very good to me. I'm certainly lucky to have another chance. it's a sad story with a happy ending.

I made a mistake, an error in judgement and learnt an important lesson. But the Chinese people I certainly respect and will continue to do so.

My apologies to Lylian with my careless wording in my previous post. I meant to not say that Chinese teachers always teach crap in thier calsses only that the content of their textbooks often avoid serious and real social issues.

For example my teacher brought up the issue of domestic violence in class, a serious issue. But most students aren't married so it doesn't really relate to their lives but I told her that often violence steams from underlying issues.

I used my personal experience as an example that if provocations arise sometimes tempers fray and things happen. Obviously talking about an issue in front of your classmates it might embarrass the teacher so I asked her after class how my course of study could prepare me for making a statement to the police and then being summoned to court and making a written statement there, understanding family law without legal counsel she simply she said she didn't know.

I was at the police station for eight hours, in the next room for two hours when they interrogated them and got them to confess their culpability. You never know the limitations of your Chinese until you run into the police, legal and medical professions.

The point I was trying to make was I don't know criminal or civil law in the PRC the stuff I learned at school did not apply in real life. Being informed of my legal rights at court was a nightmare. I must read and then sign legal documents that are complex. I wasn't allowed a translator unless it was court appointed and they didn;t have anybody on staff in legal training in English so it couldn't be done.

You must careful as to what you say because it's recorded, written into a statutory declaration and then signed. No mis understandings once you sign on the dotted line. Chinese teachers are teachers not lawyers they don't understand complex legal issues that's not their job.

International lawyers here deal in commerce, contract law etc not criminal law generally speaking.

I didn't mean to attack Chinese teachers in general or you in particular but often they can't give me any useful legal advice . If my teacher doesn't know what chance do we students have.

You have done the right thing by coming onto this forum for a second opinion.

I was married to a Chinese woman until recenty. One night she brought up the topic of the financial hardships of her family members and how easy it would be for them on australia's generous social system.

I was sympathetic to their case but I pointed out to her that all this being true it was also irrevelant due to the fact that she and her family members were neither Australian citizens or permanent residents.

Three weeks later she returned and delivered an ultimatium as follow

1. I was to lodge an application for permanent residence status on her behalf immediately, it was to be approved within the month.

2. Permanent seperation

3. Legally adopt a child although I was to have no regular contact with the kid.

If I didn't consent to all of the above the family would reserve the right to take further action against me. (unspecified) Now all of this was bad enough but the manner in which it as delivered was interesting. Her tone varied from straight offensive, demeaning even threatening.

I immediately contacted my embassy (as you should) and they told me that we couldn't even apply for permanent visa status for two reasons . The first being that we needed to have been married for at least 12 months and second be co habitating (which we were). So any application would not have been successful.

To legally adopt a child in China as a foreigner I needed to provide proof of income, notorizied by the embassy and a certificate of employment from my employer in China. ( I couldn't provide either as I work off the books here)

When I raised these concerns with her I was just sneered at . I mean even the advice of the embassy was rejected out of hand. They simply said that unless I signed a false statuory declaration with the embassy to the effect that we were co habitating then further action against me was forthcoming.

The advice I got from my embassy is that a parent or legal guardian of an Australian citizen can apply for permanent residence in Australia. They even threatnen to have a third party lodge an application in my name using my particulars with the embassy to have the visa issued.
I contacted my embassy and had them red flagged.

A night when I was out they broke into my home and stole my passports. credit card and money. I came home and a major confrontation broke out. They threatened to evict me forcibly from the premises and steal everything in the apartment unless I went ahead with the application, adoption etc.

I contacted the police who arrrested them and the returned my belonging under threat of prosecution. I can't speak highly enough of the police on this matter. A report was lodged and I informed the embassy of the theft and recovery of the passport as I'm required to do by law.

Please note the following

1. As mentioned before, you need your spouse's consent to travel with the kid out of the country. It must be in writing.

2. Intimidation, coercion even violence are simply tools, means to an end. Never invite trouble but expect it. They will hassle your employer until you are fired, your friends, steal your things and so on.

3. Check with your embassy to see if your spouse or ex spouse can apply for residence in Sweden now or at any point in the future.

4. Check the laws regarding adoption also custody to see if they can claim custody of the kid. As far as his nationality is concerned they could simply register the kid with the local authorities and claim he's Chinese by descent. Check this with the embassy.

5. They are trying to establish a bond with the kid as a counterweight to your influence that means removing you for his sphere of influence. they might be thinking your marriage is on the rocks so they are thinking past you.

6. Make sure that kid doesn't leave your sight once you lose him you;ll won't be able to track him down.

7. Don't make your concerns known to your wife or your in laws especially the leaving the country with your kid part. Possession is 90% of the law.

I agree that schools should teach practical stuff in school instead of the crap they teach now.

This is not intended as an anti Chinese or anti inter racial marriage thing as I know lots of foreigners who have successful marriages with Chinese in Kunming. Each case has its own particular circumstances.

But in laws have their own agendas and if your wife can't rise above that then expect more of the same.

I agree with a previous post about not putting up with any $#*& from relatives or in laws. if they become confrontational call 110, if you blink you'll be lost.

I've had hired goons come after me, been asked to have meetings to secluded places, people go to the police station to look up my details on the computer so on and so forth.

Always be ready to make a move at once and keep your true friends close they will be invaluable to you if nothing happens.

Some consulates and embassies while closed and still able to respond to requests for assistance after hours in the middle of the night. They did in my case.

The grandparents can look after the kid there's no need for an adoptation unless they intend to remove you in the near future.

Star Sports was the tradtional broadcaster for the RWC (1999,2003 and 2007) via satellite for the mainland.

CCTV 5 has never broadcast the any IRB sanctioned event including the RWC.

I spoke to the owner of Ganesh two months and asked him the same question he asked me and he told me that the holder of the broadcasting rights for sporting events often change. So unless they can be sure of who holds the rights by the time the RWC comes around in September there's no point in subscribing for the service.

Star sports holds the broadcast rights for the annual A5N tournament. A recent check of their website reveals that they are not covering the Six nations tournament and there is no rugby scheduled for broadcast for the next 30 days.

Conclusion unless you can ascertain what satellite service has purchased the rights then it's inadvisable to purchase a satellite. The previously mentioned bars may or may not be able to tell more than this but bear in mind there are few rugby aficionados in Kunming so unless that changes between now and september there's no a big incentive in bars seeting up especially for the event.

The IRB offers a downable service online (delayed by 24 hours) where you can view the whole event, each match possibly a similar deal you can get from another online provider like myP2P.

If I were a betting man I would put my money on Star Sports picking up the rights to the RWC broadcast as in the past. I would speak to Pearce at the Ganesh that's your best bet.

Excavation is well under way on the site right now and they also seem to be boring down in the corners of the site to establish the foundations for the building. In addition to that the temp housing errected on the site has been removed. We should be able to see evidence of the superstruture rising soon.
